Das Internet der Dinge und Smart Contracts ermöglichen den Fernzugriff auf smarte Gegenstände. Ein Aspekt hiervon ist die Nutzungsblockade gekaufter Sachen, mit der sich die Dissertation beschäftigt. Kann der Verkäufer seine Pflichten zur Eigentums- und Besitzverschaffung erfüllen, wenn die Kaufsache mit einer Blockadevorrichtung versehen ist? Stellt die Vorrichtung einen Sachmangel dar? Was gilt, wen ein Dritter gutgläubig das Eigentum an der Sache erwirbt? All diesen und weiteren Fragen widmet sich die Dissertation. Zudem wird untersucht, ob und wie die Blockadevorrichtung in AGB geregelt werden kann. The accelerating pace of technological development also poses new challenges for civil law. The Internet of Things and smart contracts enable remote access to smart objects. One aspect of this is the blocking of use of purchased objects, which the dissertation deals with. Can the seller fulfill its obligations to provide ownership and possession if the purchased item is equipped with a blocking device? Does the device con-stitute a material defect? What happens if a third party acquires ownership of the item in good faith? The dissertation addresses all these and other questions. It also examines whether and how the blocking device can be regulated in general terms and conditions. |
