Zusammenfassung: | In this volume, the third in his trilogy on the philosophical and legal aspects of war and conflict, Larry May locates a normative grounding for the crime of aggression - the only one of the three crimes charged at Nuremberg that is not currently being prosecuted - that is similar to that for crimes against humanity and war crimes. He considers cases from the Nuremberg trials, philosophical debates in the Just War tradition, and more recent debates about the International Criminal Court, as well as the hard cases of humanitarian intervention and terrorist aggression. His thesis refutes the traditional understanding of aggression. At Nuremberg, crimes against humanity charges were only pursued if the defendant also engaged in the crime of aggression. May argues for a reversal of this position, contending that aggression charges should be pursued only if the defendant's acts involve serious human rights violations |

May argues for a reversal of this position, contending that aggression charges should be pursued only if the defendant's acts involve serious human rights violations Internationaler Gerichtshof (DE-588)36344-3 gnd rswk-swf Aggression (International law) Crimes against humanity Criminal intent International criminal courts Völkerrecht (DE-588)4063693-8 gnd rswk-swf Politik (DE-588)4046514-7 gnd rswk-swf Menschenrechtsverletzung (DE-588)4276272-8 gnd rswk-swf Verhältnismäßigkeitsgrundsatz (DE-588)4191765-0 gnd rswk-swf Kriegsrecht Völkerrecht (DE-588)4165706-8 gnd rswk-swf Gerechter Krieg (DE-588)4136037-0 gnd rswk-swf Angriff (DE-588)4142472-4 gnd rswk-swf Pazifismus (DE-588)4075961-1 gnd rswk-swf Verbrechen gegen die Menschlichkeit (DE-588)4124385-7 gnd rswk-swf Angriff (DE-588)4142472-4 s Völkerrecht (DE-588)4063693-8 s Menschenrechtsverletzung (DE-588)4276272-8 s Verbrechen gegen die Menschlichkeit (DE-588)4124385-7 s Kriegsrecht Völkerrecht (DE-588)4165706-8 s Internationaler Gerichtshof (DE-588)36344-3 b 1\p DE-604 Pazifismus (DE-588)4075961-1 s Politik (DE-588)4046514-7 s Verhältnismäßigkeitsgrundsatz (DE-588)4191765-0 s Gerechter Krieg (DE-588)4136037-0 s 2\p DE-604 Erscheint auch als Druckausgabe 978-0-521-71915-5 Erscheint auch als Druckausgabe 978-0-521-89431-9 https://doi.org/10.1017/CBO9780511611551 Verlag URL des Erstveröffentlichers Volltext 1\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk 2\p cgwrk 20201028 DE-101 https://d-nb.info/provenance/plan#cgwrk |
