DEMOCRACY
(SUMMARY)
The book „Direct Democracy" aims at creating a theory on direct
democracy, as a complex phenomenon that consists of a system of in¬
stitutes, with their theoretical, national and copmarative legal aspects.
The main theses of the book are the following. First, there have never
existed either a historic or a contemporary model of a state that have
been construed as a full direct democracy. It is also not possible to es¬
tablish such a society ruled entirely under the regime of direct democ¬
racy in the future. Second, direct democracy has a „chameleonic" es¬
sence that is very much context dependent. Third, direct democracy is
a „knife with two edges" that can enhance the democratic character of
the system but also could lead to the establishment and legitimation of
authoritarian regimes. Fourth, direct democracy puts the people in the
role of a veto player, thus improving the responsibility and responsive¬
ness of the institutions of representative democracy in the interest of
the population. The people are turning into a functional equivalent of
a state institution by using the direct democratic instruments for decid¬
ing personal or substantive issues. Fifth, the institutes of direct democ¬
racy are serving also as means of constitutional communication.
Hence, the development of direct democracy leads also to the im¬
provement of deliberative democracy.
In Chapter I an attempt has been made to create a general theoreti¬
cal background pertaining to the main issues that concern direct de¬
mocracy. The focus of the analysis is put mainly on: the relations be¬
tween the different concepts of sovereignty and direct democracy the
functions of direct democracy; its history, advantages, and disadvan¬
tages, as well as the ways in which the political parties, lobbies and
other public actors use the

In Chapter II a general classification of the forms of direct democ¬
racy has been made. The first distinction is between forms of direct de¬
mocracy concerning personal issues (election, recall and peoples' vote
of non-confidence), forms of direct democracy concerning substantive
issues (initiative, referendum, general meeting of the population and
territorial plebiscite), and mixed

(personal plebiscite). The sec¬
ond distinction is between forms of direct democracy on the input side
of the governmental process (initiatives), forms of direct democracy
on the output side of the governmental process
(referendums),
and
forms that comprise the whole process (general meeting of the popu¬
lation). Differentiation has also been made pertaining to the level (na¬
tional, regional, local, etc.) on which the form is regulated and applied,
as well as the substantial issue (constitution, act, international treaty
etc.) that it concerns. All direct democratic forms have been separately
analysed in a theoretic and comparative perspective. Distinctions have
been made between personal and territorial plebiscites. The territorial
plebiscites have been compared with
referendums
for authonomy,
devolution and independence. Evidence on the existence of a peoples'
vote of non-confidence, as an independent institute of direct democ¬
racy has been given.
The book is based on a comparative analysis of direct democracy
worldwide. However, Chapter III puts a special emphasis on some of
the leading countries in relation to this aspect (Switzerland, Australia,
Italy, France, USA on state level) or on historically and comparativelly
interesting jurisdictions, i.e. Germany on
Länder
and local level, as
well as Austria.
Chapter IV explores the Bulgarian model of direct democracy. Af¬
ter a short history of direct democracy in Bulgaria, the actual debate in
that field has been presented on the basis of several local
referendums
that have been recently accomplished, as well as with regard to the
legislative proposals which were introduced in the 39th and 40th legis¬
lature of the Bulgarian parliament. An exhaustive analysis of the new
Law on Direct Participation of Citizens in the State Power and Local
Self-Government has been made. Finally, the book contains several
proposals for future improvement of the direct democracy model in
Bulgaria.
