The problem of legitimacy and legality is one of the key issues of mod¬
ern thought and nowhere more intensely debated than in the countries
of the former Soviet bloc. Following the anti-communist revolutions of
1989,
ed process of transformation from the totalitarian into liberal demo¬
cratic society, a transformation which has produced much soul-search¬
ing and heated debate. In this book, the author sets out to prove that
legitimation cannot be ultimately secured by the legal system and
depends on the external strategy of dissent.

To speak about law is always and necessarily to be engaged in a dis¬
course about both justice and power. While law s relationship to jus¬
tice is everywhere contingent and uncertain, law completely divorced
from power is unthinkable. And, while law need not be virtuous to be
law,

Power is intended to take a broad view of legal scholarship. It will pub¬
lish books by social scientists, humanists and legal academics which

tice is inseparable from social practices and analyze law as one form of
power, one way of constituting, controlling and changing the social
world. The series will focus on state law as well as law in communities
and cultural practices and on identities and their articulation in and
through law, on law s power in the taken-for-granted world, on its role
in the complex construction of nation and national power and on glob¬
al developments which today destabilize and transform the meaning
and significance of law. It invites innovative scholarship diat crosses
disciplinary as well as geographic and temporal boundaries.
